Abortion: Alabama ruling is biggest challenge to Roe v Wade yet

There are no exceptions in the bill for cases of rape or incest, and that was a sticking point when the Alabama Senate first tried to debate the measure last Thursday.

The Republican-dominated Alabama Senate voted 25-6 for the bill that would make performing an abortion at any stage of pregnancy a felony punishable by up to 99 years or life in prison. Four Republican senators joined Democrats in voting in favor of the rape or incest exception, which was defeated 21-11.

State Sen. Vivian Davis Figures (D) filibusters in opposition to HB314, which bans abortions in all cases except the health of the mother in the Alabama State House on Tuesday.

"With liberal states approving radical late-term and post-birth abortions, Roe must be challenged, and I am proud that Alabama is leading the way", Ainsworth wrote on Twitter. Although Republicans control the chamber, Senate Democrats still could wield the powerful filibuster tool to block votes.

Roe v. Wade held that the due process clause of the 14th Amendment provides a fundamental right to privacy that protects a woman's right to abortion.

If a new MS law survives a court challenge, it will be almost impossible for most pregnant women to get an abortion there.

The state has also passed a "trigger" law, which would automatically trigger an abortion ban if Roe v Wade is overturned.

Missouri's Republican-led Senate is set to take up a bill to ban abortions after eight weeks, a move that comes as GOP legislatures across the US are emboldened by the possibility that a more conservative Supreme Court could overturn its landmark ruling legalizing the procedure.

Such a scenario would spell the end of Roe v. Wade, the 1973 ruling that established that a woman's constitutionally protected right to privacy included whether or not to have an abortion before a fetus is viable outside the womb, usually about 24 weeks into a pregnancy.

Although the bill passed the House of Representatives 74-3, some GOP state senators have expressed discomfort that the bill doesn't include an exception for rape.

Assuming Gov. Ivey signs the bill into law, it will be interesting to follow its trajectory as it is inevitably appealed throughout the legal system.

"I think Alabama legislators are trying to make it impossible to uphold this law without overturning Roe", she said.

Alabama's republican governor, Kay Ivey, has not signaled if she will sign the measure into law.

Chambliss was asked about the legal costs the state would incur if the bill becomes law and is challenged in court. But the intent is clear: To get abortion cases to the Supreme Court, where backers are confident that they will prevail.

Courts have blocked bans on the procedure in other states, and the issue ultimately may be decided by the U.S. Supreme Court.

Kentucky's six-week ban was immediately challenged by the ACLU after it was signed in March, and a federal judge temporarily blocked it.
