Federal agents seized records on a variety of subjects in raids Monday on Cohen's Manhattan office, apartment and hotel room, including payments that were made in 2016 to women who might have damaging information about Trump. Those emails, they said, indicated that Cohen was "performing little to no legal work, and that zero emails were exchanged with President Trump".
"In the process of asking for that, they have to demonstrate why it is likely evidence of a crime", said Jennifer Rodgers, a former federal prosecutor who is executive director of Columbia Law School's Center for the Advancement of Public Integrity.
Though the raids on Cohen's office and hotel room were overseen by Khuzami, people close to Trump and Cohen regard the investigation as a surreptitious attempt by the special counsel, Robert Mueller, to pry into Trump's personal life by using other prosecutors as his proxy. Sources who've seen the warrants say it appeared to them that the real target of the raids was President Trump. But, as the Times notes, the fact that agents were looking for documents related to the tape exposed a "new front" in the investigation into Cohen by the United States attorney's office in Manhattan.
Cohen was represented by Todd Harrison of McDermott Will and Emery, who also took a fallback position: A neutral special master could be used to examine the documents for privileged materials.
The interest in Cohen's communications with Trump suggests that the investigation is delving into the president's actions, legal experts said.
A subpoena is more typical, to protect attorney-client privilege.
Cohen is seeking a temporary restraining order regarding searches of Cohen's home and office by Federal Bureau of Investigation agents on Monday, a Justice Department spokesman said earlier on Friday.
Cohen has been accused of making an in-kind contribution to Trump's campaign by paying Clifford with his own money in order to benefit the president's run for office.
Mr. Cohen, you said you're not anxious at all?
Stormy Daniels' lawyer Michael Avenatti was also in the courtroom. Outside court, he said: "We have every reason to believe that some of the documents seized relate to my client". Cohen paid Daniels $130,000 before the election, and he allegedly helped coordinate a $150,000 payment McDougal from American Media Inc., the publisher of the National Enquirer.
