McCabe could be fired before Federal Bureau of Investigation retirement

According to people inside the Justice Department who spoke to The New York Times, McCabe is expected to be fired before the end of the work week, though no official decision has been made yet.

The person said McCabe is suspected of misleading internal investigators about a media leak, an allegation he denies.

In the past, the president has tried to connect the dots between McCabe and Clinton over a campaign donation his wife received from Clinton ally, former Virginia Gov. Terry McAuliffe.

In a statement, Justice Department spokeswoman Sarah Isgur Flores in a statement said the following: "The Department follows a prescribed process by which an employee may be terminated". McCabe briefly took over as the FBI's acting director after Trump fired Comey in May.

The inspector general, Michael Horowitz, announced a year ago that he would investigate several contentious decisions made at the F.B.I. and Justice Department during the 2016 presidential campaign. It's now up to Attorney General Jeff Sessions to decide if McCabe will serve the short remainder of his term.

McCabe, a frequent target of President Donald Trump's criticism even before the election, has been on leave from the Federal Bureau of Investigation since stepping down in January from his deputy director position. The report is expected to say that McCabe misled the inspector general when questioned about his actions.

"FBI Deputy Director Andrew McCabe is racing the clock to retire with full benefits", Trump tweeted in December. "That process includes recommendations from career employees and no termination decision is final until the conclusion of that process".

The situation now seems fraught for all involved.

McCabe's retirement is set to go into effect Sunday and his firing could jeopardize his pension as a 21-year veteran of the bureau, according to the report.

Firing McCabe could put Sessions in a better position with Trump, but the attorney general would have to act fast.

The disciplinary process is continuing at the highest levels of the Justice Department, and no decision has been made on the discipline McCabe will face.

The story presented McCabe as a complicated figure - one who lower level officials felt was stymieing their work, even though it detailed McCabe pushing back against Justice Department officials so the case could move forward.
