EPA Chief Plans To Repeal Obama-Era "Clean Power Plan"

On Monday, the U.S Environmental Protection Agency (EPA) that it will officially abolish the Clean Power Plan, a landmark achievement of the Obama administration to reduce greenhouse gas emissions and foster the clean energy transition in the US.

The Clean Power Plan, which sought to reduce US carbon emissions by 32 percent below 2005 levels by 2030, was government by the administrative state on a scale that has never been attempted before. In the absence of stricter federal regulations curbing greenhouse gas emissions, many states have issued their own mandates promoting energy conservation.

And then, Doniger said, "we will take Pruitt and his Dirty Power Plan to court".

"Any replacement rule will be done carefully, properly, and with humility, by listening to all those affected by the rule", he said.

Conservative and free-market groups praised the administration's decision to reverse the Clean Power Plan.

The final rule also gives states the option to work with other states on multi-state approaches, including emissions trading, that allow their power plants to integrate their interconnected operations within their operating systems and their opportunities to address carbon pollution.

EPA Administrator Scott Pruitt says the Trump administration will withdraw from Obama-era Clean Power Plan to slow global warming. Generators argued at the D.C. Circuit Court a year ago that amounts to forcing coal plants to subsidize their competitors or shut down.

At the same meeting, Pruitt announced the upcoming start of the process of withdrawing from the Clean Power Plan (CPP). Even so, outside lawyers told Utility Dive that the provisions represented new or expanded interpretation of the agency's regulatory power and be the lynchpin for future legal fights.

Pruitt's proposal said the plan went beyond the law by forcing power plants to take action to cut emissions not just at the plants but also "outside the fence line" - for instance, by investing in renewable energy. NC was the 14th highest producer of carbon emissions in 2014.

Against that baseline, "the CPP was projected to have a significant impact", the analysis said. The Clean Power Plan simply makes sure that fossil fuel-fired power plants will operate more cleanly and efficiently while expanding the capacity for zero- and low-emitting power sources. Twenty-seven states joined the challenge, which is still pending.

Pruitt made the announcement in Hazard, Ky., the heart of Appalachian coal country, where he was joined by Kentucky Republican Sen. However, the US Supreme Court voted five to four later to put it on hold.

The EPA also thinks that it is avoiding the issue of having two different entities-itself and the Federal Energy Regulatory Commission-both regulating the power grid.

"As EPA administrator, Scott is working to strike an appropriate balance between protecting water and air, and preventing the kind of job-killing over-regulation", McConnell said, adding that he's been working to "stop the war on coal in its tracks".
